Terms of Service

Welcome to MVPHub.com ("MVPHub", "we", "us", or "our"). MVPHub is operated by Zealand Design Media, an Auckland, New Zealand software studio. These Terms govern your access to and use of MVPHub, including browsing listings, submitting MVPs, buying digital products, downloading source assets, using support, and connecting seller payout accounts.

By using MVPHub, creating an account, submitting a listing, or completing a purchase, you agree to these Terms, the Privacy Policy, and any listing-specific license or support terms shown before checkout.


1. Eligibility and accounts

  • You must be old enough to form a binding contract in your jurisdiction.
  • You are responsible for keeping your account credentials secure.
  • You must provide accurate account, seller, payout, billing, and support information.
  • You may not create fake accounts, impersonate another person, evade enforcement, or use MVPHub for unlawful, fraudulent, abusive, or infringing activity.

2. Marketplace role

MVPHub is a marketplace and fulfillment platform for launch-ready MVPs, starter kits, templates, service add-ons, and related digital assets.

  • Sellers are responsible for the accuracy, legality, ownership, licensing, support promises, and maintenance of their listings.
  • Buyers are responsible for reviewing listing details, demos, licenses, stack requirements, and support scope before purchase.
  • MVPHub may review, approve, reject, hide, delist, quarantine, or remove listings and assets to protect buyers, sellers, the platform, or legal compliance.
  • MVPHub does not guarantee that a purchased product will fit every buyer's business, jurisdiction, deployment target, or production requirement.

3. Seller submissions and listing rules

Sellers must follow the MVP Submission Terms & Guidelines. By submitting or updating a listing, you confirm that:

  • you own the submitted code, content, screenshots, documentation, and assets, or have the right to distribute them;
  • your listing does not include stolen, leaked, malicious, or unauthorized material;
  • your listing license, included scope, excluded scope, support scope, price, variants, and deliverables are accurate;
  • any GitHub, external URL, uploaded ZIP, or hosted asset you provide may be reviewed for delivery, malware, abuse, licensing, and buyer safety.

You retain ownership of your submitted code and listing materials. You grant MVPHub a non-exclusive, worldwide license to host, display, reproduce, transform, scan, promote, and distribute the listing materials as needed to operate the marketplace, fulfill purchases, provide support, and market MVPHub.


4. Payments and seller payouts

MVPHub uses Stripe and Stripe Connect for marketplace payments.

  • Buyers pay through Stripe Checkout or another Stripe-hosted payment flow.
  • Sellers must connect and maintain a Stripe Connect account before paid platform-hosted listings can be sold.
  • MVPHub may apply a platform fee to paid transactions. The fee is calculated from the listing, seller commercial tier, or platform configuration and is shown or made available before selling.
  • Stripe processing fees, currency conversion fees, dispute fees, payout timing, tax reporting, and account verification are governed by Stripe and may vary by country, account type, and card type.
  • Seller payouts are made by Stripe to the seller's connected account or bank account, subject to Stripe review, reserves, disputes, refunds, onboarding status, and applicable law.

MVPHub is not a bank, card network, escrow provider, or payment processor. MVPHub does not store full card numbers, bank account numbers, SSNs, tax IDs, or government identity documents.


5. Purchases, access, and download grants

After successful checkout, MVPHub may create an order, order items, download grants, source-code access, license records, installation-support requests, or other fulfillment records.

  • Access may be tied to your account, order, selected variant, and grant limits.
  • Some assets are delivered through signed download URLs, GitHub release archives, external links, or instructions.
  • Download tokens and signed URLs may expire and may be rate-limited to prevent abuse.
  • MVPHub may block, delay, revoke, or reissue access when payment fails, a refund is issued, a dispute is opened, abuse is detected, malware is detected, or the asset is quarantined.
  • Free listings may still require an account and may still be subject to grant limits, abuse checks, and asset eligibility checks.

Do not share private download URLs, grant tokens, restricted source archives, or buyer-only instructions outside your permitted license scope.


6. Licenses and resale restrictions

Each listing may have its own license terms. Unless a listing explicitly says otherwise:

  • you may use the purchased product as a foundation for your own project or business;
  • you may not resell, redistribute, mirror, publish, or repackage the purchased product as a standalone template, marketplace item, codebase, archive, or competing digital product;
  • you may not remove license notices or claim authorship of the original seller's work;
  • you remain responsible for adapting the code, configuring secrets, complying with applicable law, and operating your final product safely.

If listing-specific license terms conflict with this section, the stricter term applies unless MVPHub confirms otherwise in writing.


Refunds

Digital products are normally final once access is delivered, but MVPHub may issue or support refunds in limited cases.

Refunds may be available when:

  • checkout succeeds but no deliverable access can be provided;
  • the delivered asset is materially different from the listing;
  • the asset is blocked because of malware, quarantine, or seller delivery failure;
  • duplicate payment or obvious payment error occurred;
  • applicable law requires a refund.

Refunds may be declined when:

  • you successfully downloaded or accessed the deliverable and the issue is a preference, change of mind, or unsupported customization request;
  • you breached the license, shared private access, abused download limits, or opened a bad-faith dispute;
  • the listing disclosed the limitation before purchase.

When a refund is issued, access may be revoked, download grants may be disabled, and Stripe may debit the connected seller account or platform balance according to Stripe's rules.


8. Reviews, comments, votes, and public content

You may post reviews, comments, votes, bookmarks, support messages, and other content where the platform allows it.

  • Reviews must follow the Reviews Policy.
  • You may not post spam, unlawful content, secrets, personal data, misleading claims, fake reviews, harassment, or content unrelated to the listing.
  • MVPHub may moderate, hide, remove, or use public content for trust, ranking, support, abuse prevention, and marketplace quality.

9. Security, malware, and acceptable use

You may not upload, submit, distribute, or link to malicious, stolen, unauthorized, or abusive material. MVPHub may scan uploaded and synced assets, store scan metadata, quarantine files, block checkout or downloads, and require manual review.

You may not attempt to bypass authentication, payment, download limits, grant limits, Stripe or GitHub authorization, rate limits, malware scanning, review workflows, or seller ownership checks.


10. Third-party services

MVPHub integrates with third parties such as Stripe, GitHub, storage providers, analytics providers, email providers, and infrastructure providers. Their terms and privacy practices may also apply.

External links, demos, seller websites, repository hosts, and third-party documentation are not controlled by MVPHub. Use them at your own risk unless MVPHub explicitly states otherwise.


11. Disclaimers and limitation of liability

MVPHub is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, uptime, uninterrupted access, and error-free operation.

To the maximum extent permitted by law, MVPHub and Zealand Design Media will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, business interruption, or costs of substitute services arising from your use of MVPHub or purchased products.

Nothing in these Terms limits rights that cannot be limited under applicable law.


12. Account suspension and termination

We may suspend, restrict, or terminate accounts, listings, downloads, support access, or seller payout eligibility when we believe these Terms, platform policies, Stripe requirements, GitHub requirements, IP rights, buyer safety, or applicable law require it.

Termination does not remove obligations that reasonably survive termination, including payment obligations, license restrictions, confidentiality, indemnity, dispute terms, and limits of liability.


13. Governing law and disputes

These Terms are governed by the laws of New Zealand. Disputes that cannot be resolved through support will be handled in the courts of Auckland, New Zealand, unless applicable consumer law requires otherwise.
