Escrow Payments for Marketplaces: When You Need It and How to Implement
Escrow Payments for Marketplaces: When You Need It and How to Implement
Escrow holds the buyer's payment until both parties confirm the transaction is complete. It protects buyers from non-delivery and sellers from chargebacks. But not every marketplace needs it.
When You Need Escrow
| Marketplace Type | Escrow Needed? | Reason |
|---|---|---|
| Freelance services | Yes | Work must be reviewed before release |
| High-value physical goods | Yes | Buyer needs to inspect before finalizing |
| Digital downloads | No | Delivery is instant and automatic |
| Rentals | Partial (deposit) | Hold deposit, charge after stay |
| Food delivery | No | Delivery happens within hours |
| Low-value physical goods | Optional | Standard shipping + tracking usually suffices |
How Escrow Works
The Flow
1. Buyer pays → Funds held on platform's Stripe account
2. Seller delivers product/service
3. Buyer confirms receipt (or auto-confirm after X days)
4. Platform releases funds to seller (minus commission)
Implementation with Stripe Connect
Method: Separate Charges and Transfers
- Charge the buyer — Create a PaymentIntent on your platform account
- Hold funds — Don't create a transfer yet; funds sit in your Stripe account
- Buyer confirms — Your app marks the order as completed
- Release to seller — Create a Transfer to the seller's Connect account
Auto-Release Timer
Always include an automatic release to prevent funds from being held indefinitely:
- Digital goods: 24-48 hours after delivery
- Physical goods: 7-14 days after delivery confirmation
- Services: 3-7 days after delivery
If the buyer doesn't dispute within the auto-release window, funds are released to the seller automatically.
Legal Considerations
Holding funds in escrow may require specific licenses depending on your jurisdiction:
| Jurisdiction | Requirement |
|---|---|
| US | Money transmitter license in some states (consult a lawyer) |
| EU | Payment institution license or use a licensed partner |
| UK | FCA authorization or use a licensed payment provider |
The Stripe Advantage: When using Stripe Connect, Stripe holds the funds — not you. This significantly reduces your regulatory burden. However, consult a legal professional to confirm compliance in your specific jurisdiction.
Dispute Handling with Escrow
| Scenario | Action |
|---|---|
| Buyer claims non-delivery | Hold funds, ask seller for proof of delivery |
| Buyer claims item not as described | Hold funds, request photos, mediate |
| Seller claims they delivered | Review evidence, decide to release or refund |
| No response from buyer within auto-release window | Release funds to seller |
| Chargeback filed | Stripe handles the dispute process |
